Auto Theft One Charge Can Change Everything. So Can One Firm.

Auto Theft Defense in Des Moines

Auto Theft Defense Backed by Polk County Court Experience

A stolen-vehicle accusation can turn on facts that aren’t obvious from the charge alone. Who owned the vehicle, whether someone had permission to use it, how long that permission lasted, and whether the vehicle was meant to be returned can all affect how Iowa law applies. We represent people facing theft-related charges in Des Moines and Polk County.

We start by reviewing the charging document and police reports, then compare them with ownership records, permission messages, witness accounts, surveillance footage, and other digital evidence. We also examine the timeline surrounding the vehicle’s use and recovery. These details may distinguish alleged theft from operating a vehicle without the owner’s consent.

Why Intent & Consent Can Change the Charge

Iowa doesn’t treat every unauthorized use of a vehicle as the same offense. Under Iowa Code section 714.1, theft can involve taking or controlling another person’s property with the intent to deprive that person of it. The statute also covers certain forms of deception and knowing control over stolen property.

Iowa Code section 714.7 addresses taking possession or control of another person’s vehicle without consent but without intending to permanently deprive the owner. The offense is often associated with alleged joyriding, but it may also involve an unreturned borrowed vehicle, disputed permission, or another form of temporary control. The distinction matters because the offenses carry different classifications and potential consequences.
