Iowa’s Robbery Statute: First & Second Degree

Iowa Code section 711.1 defines robbery as committing an assault, threatening immediate serious injury, or threatening to commit a forcible felony in order to further a theft. That combination of force and theft intent is what separates robbery from a standalone theft charge or a burglary charge. Iowa previously recognized three degrees of robbery, but third-degree robbery was repealed effective 2019. Every robbery charge in Iowa now falls into one of two categories.

First-Degree Robbery (Class B Felony)
Charged when the offender inflicts or intends serious injury, or is armed with a dangerous weapon. A Class B felony carries a sentence of up to 25 years in prison.

Second-Degree Robbery (Class C Felony)
Charged when the conduct doesn’t meet first-degree criteria. A Class C felony carries up to 10 years in prison and a fine between $1,370 and $13,660.
